International Terms of Service for Electronic Services

Article 1 - General Provisions
1.1. These Terms of Service govern the provision of electronic services and sales of goods through the Website: https://metaloove.com (hereinafter referred to as the "Website" or "Store"). 1.2. The Website is owned and operated by the Service Provider. Complete legal identity, business registration details, and contact information for the Service Provider are set forth in Article 20 of these Terms. 1.3. By placing an order or using the Website, you confirm that you have read, understood, and agree to be bound by these Terms. 1.4. These Terms of Service were adopted on September 18, 2025.
Article 2 - Types and Scope of Electronic Services
The Website provides information about the Service Provider's business activities: Online store offering metal posters, wall decorations, and puzzles with the ability to create custom products.
Services Offered:
Online Store Services: Mail-order sales of metal posters, wall decorations, and puzzles.
Personalized Products: Sale of products made to order based on user specifications.
User Account: Creation and maintenance of a customer account.
Content: Download of free content (e.g., discount coupons).
Note: Paid services are clearly marked to avoid any doubt that their use involves a payment obligation.
Article 3 - Technical Requirements
To properly use the Website, you should have:
A device (PC, tablet, smartphone) with internet connection.
A current web browser.
Full legal capacity to make purchases (minimum age requirements apply by jurisdiction).
An active email address for order processing.
Article 4 - Product Specifications
A) Standard Products (Ready-made)
Metal posters, paper posters, and puzzles from regular store inventory.
No personalization options.
Available for immediate shipment.
Subject to withdrawal rights (returnable within 14 days).
B) Creator Products
Metal posters, paper posters, and puzzles designed by the Customer using the website creator tool.
Customer independently adds text, images, chooses colors, fonts, layouts.
Made to order according to Customer specifications.
NOT subject to withdrawal rights (custom-made products are non-returnable unless defective).
C) Individual Custom Orders
Made after direct contact with Service Provider.
According to Customer's own designs, dimensions, and specifications.
NOT subject to withdrawal rights (custom-made products).
Processing Times:
Standard products: 2-7 business days.
Creator products: 2-14 business days.
Individual custom orders: As agreed.
Article 5 - Sales of Physical Goods
Order Placement: Successful order placement requires providing data specified in the order form. Data should be accurate and current. The sales contract is concluded after:
Providing required data.
Selecting shipping option.
Selecting payment method.
Clicking "Buy and Pay" (or equivalent) option.
Payment confirmation.
Upon order acceptance, the Service Provider sends a confirmation email.
Processing & Delivery:
Standard products: 2-7 business days from payment confirmation.
Personalized products: 5-14 business days from payment confirmation and project approval.
Delays will be communicated by the Service Provider.
Delivery: Multiple options available depending on region – selection made at checkout.
Inspection: If you notice any irregularities in the shipment condition (external damage), report this to the courier and create a protocol. Failure to do so may complicate warranty claims.
Payment Processing: The Service Provider enables payment through Stripe. Payment is considered complete when funds are received in the Service Provider's account.
Article 6 - Additional Sales Information
Prices shown on the Website are final (Gross) unless stated otherwise.
The Service Provider reserves the right to refuse order fulfillment if:
False data was provided, preventing contract execution.
Payment was not made within the specified time.
For physical goods, shipments were repeatedly not collected.
Article 7 - Consumer Rights (Jurisdiction Specific)
European Union (EU/EEA) Consumers in EU/EEA countries are protected under the EU Consumer Rights Directive:
Right of Withdrawal: 14-day withdrawal period for standard goods (see Article 8).
Conformity: 2-year liability period for lack of conformity.
United States For US Customers - See Article 19 for Detailed Terms (Arbitration & Class Action Waiver).
14-day return policy for standard products.
No returns for custom-made products.
Japan
Consumer Contract Act protections apply.
Specified Commercial Transactions Law applies.
Australia & Canada
Local consumer protection laws (ACL / Canadian provincial acts) apply regarding guarantees and returns.
Article 8 - Withdrawal Rights (Where Applicable)
Universal Withdrawal Policy: All Customers (Except where excluded below): You have 14 days to withdraw from product purchase contracts without giving reasons. The period counts from the receipt of goods.
⚠️ IMPORTANT - Withdrawal Exclusions: The following products are NOT eligible for withdrawal/return:
Creator Products: Designed by customer using our design tool.
Individual Custom Orders: Made to specific customer specifications. Reason: These products are manufactured specifically for you and cannot be resold.
Withdrawal Process:
Send withdrawal notice within 14 days (see Template at the end).
Return goods within 14 days of notice.
Goods must be in original condition.
Refund: Full refund (including standard shipping) within 14 days of receiving returned goods.
Cost: Customer bears direct return shipping costs.
Article 9 - Conformity and Warranty Rights
EU/EEA Standards:
Liability: 2 years for lack of conformity existing at delivery.
Remedies: Repair, replacement, price reduction, or termination.
US/Japan/Other:
Statutory warranties apply as per local law.
We guarantee products are free from material defects upon delivery.
Article 10 - Complaints and Claims Procedure

Response Timeline: The Service Provider responds within 14 days of receipt.
Article 11 - Terms Modifications
We will notify you of significant changes via email.
Changes apply only to contracts concluded after the modification date.
Article 12 - Content Reporting (DSA)
We comply with the EU Digital Services Act.
Report illegal content to our email. We respond/act within 14 days.
Article 13 - User Accounts
Accounts are free.
You are responsible for maintaining the security of your password.
We may deactivate accounts after prolonged inactivity or for violations of these Terms (spam, fraud).
Article 14 - Dispute Resolution
General Approach: We aim for amicable resolution. Please contact us first. EU/EEA: ODR Platform: ec.europa.eu/odr. United States: See Article 19 (Arbitration). Governing Law:
EU Consumers: Laws of Poland, subject to mandatory local consumer protections.
US Consumers: Laws of Delaware (for arbitration/contract).
B2B: Laws of Poland.
Article 15 - Data Protection and Privacy
We comply with GDPR (EU), CCPA (California), and other applicable privacy laws.
Privacy Policy: Available at https://metaloove.com/privacy-policy.
International Transfers: Protected by appropriate safeguards.
Article 16 - Shipping and International Commerce
Customs & Duties: For orders outside the EU (e.g., to US, Japan, UK), the Customer is the importer of record and is responsible for any applicable customs duties and taxes.
Shipping: We ship globally. Specific carriers and times are presented at checkout.
Article 17 - Limitation of Liability
EU/EEA: No limitation on consumer statutory rights regarding personal injury or intent. US/Other: To the fullest extent permitted by law, liability is limited to the amount paid for the product.
Article 18 - Intellectual Property
Our IP: All designs, logos, and website content owned by Metaloove.
Your Content: You retain rights to images you upload to the Creator. You grant us a license solely to print and fulfill your order. You warrant you have the right to use uploaded images.
Article 19 - SPECIFIC TERMS FOR UNITED STATES CUSTOMERS
⚠️ BINDING ARBITRATION AND CLASS ACTION WAIVER NOTICE
19.1. Agreement to Binding Arbitration: For US residents, disputes will be resolved exclusively by final and binding arbitration under the FAA. 19.2. Exceptions: Small claims court (individual claims). 19.3. Class Action Waiver: YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS OR JURY TRIALS. 19.4. Procedure: Administered by AAA (Consumer Rules). Service Provider pays arbitration costs for non-frivolous claims. 19.5. Opt-Out: You have 30 days from first use to opt-out by emailing us. 19.6. Governing Law: Delaware law applies to these arbitration terms. 19.7. Prop 65 (California): WARNING: Some products may contain chemicals known to California to cause cancer/reproductive harm.
